1. About these terms
These Terms of Service ("Terms") govern your access to and use of TradieToolBox, a trading name of [YOUR COMPANY NAME LTD] ("we", "us", "our"), registered in England and Wales.
By subscribing to or using TradieToolBox, you agree to these Terms in full. If you do not agree, you must not use the service. These Terms apply to all plans including Starter, Pro, and Enterprise.
2. The service
TradieToolBox provides an AI-powered call answering and job management service for plumbing businesses ("the Service"). The Service includes:
- Automated call answering when you do not answer
- Collection and logging of caller information
- SMS alerts to your designated phone number
- Appointment scheduling (Pro plan)
- WhatsApp follow-up messaging (Pro plan)
- Integration with third-party tools including Google Calendar and Make.com
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
3. Fair Use & Call Allowances
Each plan includes a monthly call allowance as set out below:
- Starter plan: 100 calls per month
- Pro plan: 100 calls per month per engineer (up to 3 engineers included)
- Additional engineer add-on: 100 calls per month per additional engineer
Call allowances are calculated based on an average call duration of 3.5 minutes. Calls that significantly exceed this average duration may be counted as multiple calls against your monthly allowance.
Calls exceeding your monthly allowance are charged at £0.75 per call. We will always notify you by email before any overage charges are applied. You will never be charged overage fees without prior notification.
We reserve the right to review usage that appears inconsistent with normal plumbing business operations. In such cases we will contact you before taking any action.
4. Subscriptions and payment
TradieToolBox is offered on a monthly subscription basis. All prices are exclusive of VAT unless otherwise stated. Subscriptions renew automatically each month unless cancelled.
Payment is taken at the start of each billing period. If payment fails, we reserve the right to suspend access to the Service until payment is made.
We do not offer refunds for partial months. If you cancel mid-month, you will retain access to the Service until the end of your current billing period.
5. Cancellation
You may cancel your subscription at any time with no penalty. Cancellations take effect at the end of your current billing period. To cancel, contact us at hello@tradietoolbox.co.uk.
6. Your responsibilities
By using TradieToolBox, you agree to:
- Provide accurate business information during setup and keep it up to date
- Ensure callers are informed that calls may be recorded (we handle this automatically)
- Not use the Service for any unlawful purpose
- Not attempt to reverse engineer, copy, or resell the Service
- Comply with all applicable laws in your use of the Service
- Ensure your use of the Service complies with UK GDPR as a data controller
You are responsible for all activity that occurs under your account. Keep your login credentials secure and notify us immediately of any unauthorised access.
7. Data and privacy
Our collection and use of personal data is governed by our Privacy Policy. By using the Service, you acknowledge that we process caller data on your behalf as a data processor, and you act as the data controller for that information.
You are responsible for ensuring you have a lawful basis for collecting caller data through the Service and that your use complies with UK GDPR and PECR.
8. Disclaimers
TradieToolBox is provided "as is". While we work hard to maintain a reliable service, we do not guarantee that the Service will be uninterrupted, error-free, or available at all times.
The AI assistant is designed to capture information accurately, but we cannot guarantee that all caller information will be captured correctly in every case. You should always verify critical job details directly with the customer before attending a job.
TradieToolBox is not a replacement for professional judgement. We are not responsible for decisions made based on information captured by the Service.
9. Limitation of liability
To the maximum extent permitted by law, our total liability to you in connection with the Service shall not exceed the total fees paid by you in the 3 months preceding the event giving rise to the claim.
We are not liable for any indirect, incidental, consequential, or special damages including loss of revenue, loss of profits, or loss of data arising from your use of the Service.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.
10. Intellectual property
All intellectual property rights in TradieToolBox — including the software, design, brand, and content — belong to us. You are granted a limited, non-exclusive, non-transferable licence to use the Service during your subscription.
Job data and transcripts generated from your calls remain yours. We do not claim ownership over your business data.
11. Termination
We reserve the right to suspend or terminate your access to the Service immediately if you breach these Terms, fail to pay, or use the Service in a way that causes harm to others or to us.
On termination, your right to access the Service ends immediately. We will make your data available for export for 30 days following termination, after which it may be deleted.
12. Changes to these terms
We may update these Terms from time to time. We will give you at least 30 days' notice of any material changes by email. Continued use of the Service after that date constitutes acceptance of the updated Terms.
13. Governing law
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
